Because Liberty had limited generation capacity at the time, the two companies entered a five-year power supply contract so customers would not face disruption.

Liberty later developed its own resources, including a solar facility near Luning, Nevada, and purchases from a solar project near Reno. The original contract was extended multiple times as both utilities worked through transmission limitations that prevented Liberty from buying power on the open market.

Transmission Capacity as the Central Obstacle

Attempts by Liberty to end the agreement earlier ran into a practical barrier: NV Energy lacked enough transmission capacity to support wholesale purchases from other suppliers. Regulators were informed of this shortfall in 2020, leading to another extension of the supply deal. Liberty had expected construction delays that might push resolution into the 2030s.

NV Energy began investing in additional transmission infrastructure in 2025. As that work advances, the utility has notified Liberty that the original plan to transition away from the supply contract can now proceed. The companies have confirmed that NV Energy will continue delivering power until Liberty gains independent access to the wholesale market.
